# Recording Jia's Rights Protection: Use These Two Tactics When Dealing with Unpaid Debts!
In 2015, equity crowdfunding was booming, and I got caught up in the excitement too, investing 20,000 yuan in a project about chronic disease management. Later the project fell through, the actual controller went silent, and I gradually forgot about it.
In 2021, the other party suddenly showed up, signed a buyback agreement, paid back 10,000 yuan and disappeared again. The phone number was disconnected, they ghosted, and I had no idea where the paper agreement went. Combined with the pandemic years, I always felt that without a contract, without a company, and unable to find the person, there was no hope for that money.
Last night I saw someone in my WeChat Moments having dinner with him. I tried sending him a message... guess what happened? This morning, two transfers came through: 5,000 + 5,000, settled instantly.
This experience taught me a lot 👇
1⃣ First, assess whether the debt is worth the effort. If it is, collect evidence. Although I didn't find the paper contract, he admitted in our chat history that he owed money and promised to repay it—that's solid proof.
2⃣ Apply for a payment order
If the debtor currently has a fixed residence and you can contact them, you can apply for a "payment order" from the court in their jurisdiction. If the court accepts it and they don't file a written objection within 15 days, it becomes enforceable.
3⃣ Small claims procedure
If applying for a payment order doesn't work, just file a lawsuit directly. Anything under 50,000 yuan qualifies as small claims, which has a faster process and lower court fees—just tens of yuan.
To be honest, I was surprised how quickly he repaid me. I had actually found various information about him and was planning to intimidate him, but he immediately caved.
I spent over 100,000 yuan total on Niutou.com. Besides one new air purification project that made money, all the rest went belly-up.
If back then I had been on the "pirate ship" of BTC instead of equity crowdfunding, I probably wouldn't need to be collecting debts everywhere now 🤣
