According to Jared Birchall’s testimony on day 4 of Musk’s OpenAI lawsuit, xAI’s $974 billion bid for OpenAI’s nonprofit assets aimed to prevent Sam Altman from undervaluing the assets during OpenAI’s restructuring. However, Judge Yvonne Gonzalez Rogers questioned how Birchall could present a $974 billion offer without clearly explaining who determined the valuation or which parties were involved in discussions.

OpenAI’s lawyers argued the testimony should be excluded, citing potential influence from legal counsel. The Verge noted that Musk’s legal team may have inadvertently opened the door for OpenAI to further investigate the xAI bid’s underlying materials.
