The U.S. International Trade Commission overturns the U.S. Department of Commerce’s ruling, and will not impose double anti-dumping and countervailing duties on active anode materials imported from China.

On March 12th local time, the U.S. International Trade Commission (ITC) issued a statement saying that imported active anode materials from China have not caused a substantial impediment to the establishment of related U.S. industries. The statement said that based on the above negative ruling by the commission, the U.S. Department of Commerce will not issue anti-dumping or countervailing duty orders on such Chinese imports. Previously, on February 11th, the U.S. Department of Commerce announced a final affirmative determination of anti-dumping on imported active anode materials from China, ruling that the dumping margin for Chinese producers/exporters with a separate rate was 93.50%, and the nationwide unified rate was 102.72%. At the same time, an affirmative final determination of countervailing duties was made on Chinese involved products, with subsidy rates ranging from 66.82% to 66.86%.
